We are looking for a freelance IP Attorney to join our team!
You will be responsible for supporting our clients - US-based start-ups funded under the Small Business Innovation Research (SBIR) program - by providing legal support for their intellectual property needs. A comprehensive strategy to safeguard IP against infringement is crucial security for start-ups to preserve their competitive advantage, enhance brand reputation, and attract investors and other potential partners. You will work on a wide range of matters including patent applications, trademark registrations, copyrights, trade secrets, and freedom-to-operate analyses. This position offers a great opportunity to work with start-ups developing new technology across various sectors such as medtech, pharmaceutical, energy, and IoT.
DUTIES AND RESPONSIBILITIES
Advise companies on legal rights and actions involving intellectual property;
Educate company management groups in areas related to intellectual property law and best practices for intellectual property procurement and protection;
Interact with companies to understand their business and technology with the aim of identifying protectable subject matter;
Conduct IP research including prior art searches, patentability assessments, trademark clearance searches, and Freedom to Operate searches;
Prepare, review, and file legal documents such as patents, trademark papers, and copyright registrations;
Draft and review other IP-related agreements such as licensing agreements and non-disclosure agreements.
JOB REQUIREMENTS
Minimum of 5 years of experience practicing as an IP Attorney, with a focus on intellectual property law, including patent and trademark prosecution;
Juris Doctor (J.D.) from an accredited law school;
Registered to practice before the United States Patent and Trademark Office (USPTO);
Bar admission in good standing;
Strong understanding of U.S. and international IP laws and regulations;
Experience conducting Freedom to Operate (FTO) searches;
Experience working with start-ups or technology companies is preferred;
Exceptional research, analytical, and problem-solving skills;
Excellent written and verbal communication skills;
Ability to work independently, prioritize tasks, and manage multiple projects;
Proven ability to maintain positive client relationships.
